GUEST TERMS AND CONDITIONS

This Short Term Rental Agreement (the “Agreement”) is made effective as of the signing date by and between the Property Owner/Operator (the “Owner”) and the Guest (collectively, the “Parties”). Any terms not specifically covered in this Agreement will be governed by the House Rules or the Reservation Policies, which are provided separately by the Owner.

Agreement Binding

These Terms and Conditions are legally binding. As the individual who made the reservation, you are personally responsible for adhering to these Terms and Conditions. The credit card used to make the reservation may be charged for any damages or fees resulting from violations. You are also responsible for sharing these Terms and Conditions with anyone (i) on whose behalf you made the reservation, or (ii) whom you or any other guest invite to use, occupy, or enter the Property.

In consideration for using the Property and receiving the Services, you agree to comply with the following Terms and Conditions:

Occupancy Restrictions


You must be present at the Property for the entire duration of your reserved stay. Occupants are limited to your family members, friends, responsible adults, and children under direct adult supervision. You are not permitted to exceed the maximum occupancy limit specified in the listing or advertisement of the Property at any time.For example, if the listing indicates that the Property accommodates up to ten people, you must ensure that no more than ten people are present at the Property at any given time, regardless of whether they are sleeping or simply visiting.You are required to inform Blue Gems Mgmt LLC of the total number of individuals who will be staying at the Property during your reservation. Failure to adhere to the Property’s advertised occupancy limit may result in the termination of your reservation and eviction from the Property without a refund. Additionally, you may be charged a minimum service fee of $200.00, or more depending on any resulting damages, and the credit card on file may be charged accordingly.


Cleaning and Housekeeping


We kindly ask for your cooperation in maintaining the cleanliness of the Property during your stay. To assist our cleaning crew, please:

Leave the Property tidy.

Run the dishwasher before departure.

Start washing used towels.

Take out the trash and dispose of it in the designated receptacles outside the Property.

Wash any remaining dishes.

Keep towels in the bathrooms and sheets in the bedrooms.

Refrain from rearranging furniture.
Additionally, please report any problems or damages to Blue Gems Mgmt LLC promptly. Your cooperation is greatly appreciated and helps us ensure a pleasant stay for all guests.


Excessive Wear and Tear


If we discover evidence of intentional excessive wear and tear at the Property—such as intentional spills, trash left behind, stains on furniture, or damage to carpeting, linens, paint, wallpaper, or flooring—we reserve the right to charge the credit card on file or otherwise collect additional fees at our discretion.You will receive a receipt for any additional charges upon request or as required by applicable law. In the event of such charges, they will be processed through the credit card on file.Additionally, a separate smoke cleaning fee of $500 may be charged, in addition to any cleaning fees paid at the time of booking, if smoking is detected in the Property.

Check-In and Check-Out


Unless otherwise instructed, check-in time is 4:00 p.m. local time, and check-out time is 10:00 a.m. local time. Late check-outs or early check-ins are not guaranteed and must be coordinated with us prior to your arrival.


Age Requirements and Third-Party Reservations


To book one of our properties, you must be at least 21 years old. Reservations cannot be made on behalf of anyone under the age of 21. Additionally, reservations cannot be made for individuals who will not be physically staying at the property. The person making the reservation must be present at the property for the entire duration of the stay.

No Events


Events, including but not limited to parties, weddings, commercial activities, promotional activities, or any other gatherings (collectively referred to as “Events”), are strictly prohibited at the Property unless prior express written permission is obtained from Blue Gems Mgmt LLC.

If an Event is approved, Blue Gems Mgmt LLC reserves the right to charge an additional event fee, the amount of which will be determined at our sole discretion.


Noise Restrictions and Illegal Activity


Guests must avoid any activities that disrupt the quiet enjoyment of neighbors and others in the surrounding community. Parties and any noise that can be heard beyond the Property’s lot line or in adjacent units are strictly prohibited. Specifically, noise levels should not disturb neighbors after 9:00 p.m. on weeknights or 10:00 p.m. on weekends.Guests are also prohibited from engaging in any illegal activities on the Property. If we receive complaints about excessive noise or discover illegal activities, we reserve the right to terminate your reservation immediately. In such cases, you will not receive a refund, and the credit card on file may be charged a minimum service fee of $500.00, in addition to any other charges incurred by Blue Gems Mgmt LLC due to the activities, including but not limited to fines and legal expenses.


Respect for Property and Community


Guests are expected to treat the Property and its furnishings with the highest level of care and respect, as if they were their own home. Additionally, guests must conduct themselves courteously towards neighbors and other residents in the community where the Property is located.

Any reported or observed instances of disrespect or misbehavior may result in immediate cancellation of the reservation. In such cases, all guests and occupants will be required to vacate the Property without a refund.


Third-Party Vendors


During your stay, cleaners, maintenance personnel, and other third-party service providers (collectively, “Third-Party Vendors”) may enter the Property. This includes any contractors, vendors, or service providers hired by you or by Blue Gems Mgmt LLC.Blue Gems Mgmt LLC, along with its employees, representatives, owners, and affiliates, will not be liable for any losses, thefts, injuries, illnesses, or other damages related to the presence or services of Third-Party Vendors. Any claims for compensation or recovery for such losses, damages, or injuries must be directed solely to the Third-Party Vendor, regardless of whether they were hired by you or by Blue Gems at your request.


Parking. 


Parking arrangements vary by property, and some locations may have restrictions on the number of vehicles allowed. Additionally, local cities and towns have their own parking regulations and restrictions.Guests are responsible for adhering to these regulations and must follow any parking instructions provided by Blue Gems Mgmt LLC, as well as local signage and posted regulations. It is your responsibility to research and ensure compliance with all applicable parking rules, laws, and restrictions.Blue Gems Mgmt LLC and its employees, representatives, owners, and affiliates are not liable for any parking violations, citations, tickets, towing costs (whether lawful or unlawful), or any other expenses incurred due to parking infractions.


Pets.
 


Unless explicitly stated in the listing that pets are allowed, any indication or reasonable suspicion of a pet being present at the Property will result in an additional charge up to $500 or an additional pet fee. This fee will be equal to the original cleaning fee and will be charged to the credit card on file or otherwise collected. This pet cleaning fee is separate from and in addition to any cleaning fee paid at the time of booking.


Phone, Internet, and Cable


Unless otherwise specified, all properties are equipped with Wi-Fi internet; however, connectivity quality may vary. Wi-Fi passwords will be provided upon request.

Generally, our properties do not include phone or cable TV services. Some properties may have smart TVs that offer access to third-party streaming services, but this is not guaranteed for all properties. If you need information about the specific devices and services available at the Property, please contact us before booking.

Please note that we are not responsible for power outages, internet disruptions, or other utility interruptions. Such issues are beyond our control, and we do not offer refunds or compensation for any inconvenience caused by these disruptions.


Recreational Equipment


If the Property includes a rooftop deck, patio, stairs, outdoor grill, pool, hot tub, exercise equipment, or any other recreational amenities (collectively, “Recreational Equipment”), all guests are required to follow any posted or written rules and policies related to the use of such equipment. Guests must exercise reasonable care at all times while using these facilities.

Children must be supervised by an adult whenever they are near or using Recreational Equipment. Please be aware that decks, patios, and stairs can become slippery when wet or icy, posing a risk of injury. Always exercise caution to prevent accidents.


Amenities and Common Areas


Blue Gems Mgmt LLC makes no warranties or representations regarding the usability or condition of amenities or common areas that are owned, maintained, or provided by homeowners or condominium associations. This includes, but is not limited to, pools, hot tubs, clubhouses, tennis courts, golf facilities, and picnic or beach areas (collectively referred to as the “Common Areas”).

We are not responsible for the operation or malfunction of these amenities, nor for any injury, damage, loss, theft, or other incidents that may occur within the Common Areas.


Access and Maintenance. 


Blue Gems reserves the right to enter the Property at any time during your stay. We will diligently attempt to address any maintenance issues which are reported to us. If a maintenance issue cannot be fixed in a reasonable amount of time, or if the Property is unavailable or inaccessible for any reason, we reserve the right in our sole discretion to issue a partial or full refund or offer alternative, comparable accommodations. 


Guest Contact.


At Blue Gems, our goal is to deliver an unparalleled experience for every guest. To customize your visit, we will contact you several weeks before your arrival to gather essential details about your trip, including the number of guests and their age range. This information helps us provide tailored recommendations for activities and services, and is also used to confirm your reservation.To facilitate smooth communication, you agree to receive text messages, emails, and phone calls from us both prior to and following your reservation. By agreeing to this rental agreement, you authorize Blue Gems to use these methods to communicate with you.Please ensure that you respond to our communications at least 48 hours before check-in. If we do not receive a response within this timeframe, Blue Gems reserves the right to cancel your reservation due to insufficient communication.




 Sale Contingency or Portfolio Removal


In the rare event that the Property is listed for sale, sold, or removed from our portfolio, Blue Gems Mgmt LLC reserves the right to either:

             Provide comparable accommodations at no additional cost, or 

             Cancel and fully refund your reservation.

We will make every effort to address any such issues promptly and ensure minimal disruption to your stay.



Physical Disabilities of Guests.
 


If you or any other guest has a physical or mental disability of any kind, the disability must be disclosed to Blue Gems at or before the time of booking. We do not discriminate against anyone with disabilities and will do our best to accommodate disabilities, but guests are responsible for informing Blue Gems of any disabilities to ensure the Property is suitable for all guests’ needs at or prior to the time of booking.


Surveillance and Security Cameras. 


Blue Gems utilizes security cameras at some properties. These cameras are located on the outside of the properties only. Since our properties are full-time vacation rentals, these cameras are there for the protection, safety, and security of the properties and our guests. We do not install or use cameras on the inside of any of our properties.


Payment. 


We accept payments with all major credit cards and will only accept reservations if (i) there is a valid credit card on file, or (ii) the reservation has been confirmed through a credible third-party online transaction agency (“OTA”) such as Airbnb or VRBO. For any reservation where a credit card is on file, these Terms and Conditions shall prevail, control, and supersede any other or conflicting terms and conditions of the OTA. For all reservations for properties in our portfolio which are made with Blue Gems directly over the phone or through our our website we charge at the time of booking a deposit equal to 51% full rental rate and all associated fees, and the remaining balance shall be due and payable no later than 7 days prior to your arrival. You hereby authorize us to charge the card on file for any balance that remains due after the initial booking in accordance with the terms of this paragraph.


Cancellation and Refunds. 

You acknowledge that Blue Gems Mgmt LLC incurs a 4% credit card transaction fee for each booking and an additional 4% fee for each refund issued in the event of a cancellation (collectively referred to as “Credit Card Transaction Fees”). To cover these fees, Blue Gems Mgmt LLC will retain an amount equal to 8% of the original booking amount for any refunds issued due to cancellation

Refunds are issued as follows:

Cancellations made at least 30 days prior to the scheduled arrival date: A 92% refund will be credited back to the original form of payment, minus all Credit Card Transaction Fees.

Cancellations made between 29 and 15 days prior to the scheduled arrival date: A 42% refund will be credited back to the original form of payment, minus all Credit Card Transaction Fees.

Cancellations made 14 days or less before the scheduled arrival date: No refund will be issued, and all amounts paid at booking will be retained by Blue Gems Mgmt LLC.

For bookings made through Online Travel Agencies (OTAs) such as Airbnb, VRBO, or Booking.com, the refund policy will be governed by the policies of the respective OTA and the terms agreed upon at the time of booking.


Additional Terms and Conditions.
Your booking is also subject to any additional terms, conditions, policies, and agreements located on Blue Gems' website. 


Acknowledgment of Terms and Conditions



By reserving and booking this Property, you agree that you have reviewed, understood, and accepted the Terms and Conditions outlined herein, as well as any additional terms set forth in the attached exhibits, regardless of whether you have physically signed or otherwise acknowledged this document.
