Our total liability for claims arising out of or related to the site will not exceed the greater of 100 dollars or the amount you paid to us for site access in the 12 months before the claim.

You will defend, indemnify, and hold harmless Blue Gems Management and its affiliates from and against any claims, damages, liabilities, costs, and expenses arising out of or related to your misuse of the site, your content, or your violation of these terms or applicable law.

14) Governing law and venue

These terms are governed by the laws of the State of Florida, without regard to conflict of laws rules. You agree to the exclusive jurisdiction and venue of state and federal courts located in Florida for any dispute not subject to arbitration.

15) Dispute resolution and arbitration

Before filing a claim, the parties will try to resolve disputes informally for 30 days. If not resolved, any dispute arising out of or relating to these terms or the site will be finally resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Either party may seek relief in small claims court. The arbitration will take place in Florida, in English. The arbitrator may award individual relief only. Class actions and class arbitrations are not allowed. You may opt out of this arbitration clause within 30 days of first accepting these terms by emailing [email protected] with subject “Arbitration Opt Out” and your full name.

16) International use

We operate from the United States. You are responsible for compliance with local laws.

17) Termination

We may suspend or terminate your access at any time for any reason. Sections that by their nature should survive termination will survive.
